1. Agreement to Terms

By accessing or using FundMyCourse.ca ("the Service"), operated by BBN LABS INC, a Canadian federal corporation ("we," "us," "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

These Terms constitute a legally binding agreement between you and FundMyCourse.ca. Please read them carefully.

2. Eligibility

2.1 Age Requirements

  • You must be at least 13 years of age to create an account and use the Service.
  • If you are under 13, you may only use the Service with verified parental or guardian consent. See our Privacy Policy for details on the parental consent process.
  • If you are between 13 and 17, you represent that you have reviewed these Terms and understand them, or that a parent or guardian has reviewed them with you. We recommend that users under 18 discuss account creation with a parent or guardian.
  • If you are under the age of majority in your province or territory (18 in most provinces, 19 in British Columbia, New Brunswick, Newfoundland and Labrador, Northwest Territories, Nova Scotia, Nunavut, and Yukon), you represent that your parent or guardian has reviewed and agreed to these Terms on your behalf.

2.2 Geographic Scope

FundMyCourse.ca is designed for users in Canada but is available to anyone worldwide who wishes to explore Canadian education funding opportunities. Scholarship and funding listings are specific to Canada and Canadian institutions. Users outside Canada are welcome to browse and use the Service, but they should understand that eligibility for listed funding opportunities may require Canadian residency, citizenship, or enrollment at a Canadian institution.

2.3 Account Creation

You may browse scholarship listings and content on FundMyCourse.ca without creating an account. Account creation is required to access personalized features, including profile-based matching, bookmarks, application tracking, and deadline reminders.

3. Account Responsibilities

3.1 Accurate Information

You agree to provide accurate, current, and complete information when creating your account and maintaining your profile. Providing false information may result in inaccurate scholarship matches and may lead to suspension or termination of your account.

3.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials. You agree to:

  • Choose a strong password and not share it with others.
  • Notify us immediately at support@fundmycourse.ca if you suspect unauthorized access to your account.
  • Not access another user's account without their permission.

We are not liable for any loss or damage arising from your failure to protect your account credentials.

3.3 One Account Per Person

Each individual may maintain only one personal account. Creating multiple accounts to circumvent restrictions or manipulate the service is prohibited.

4. Description of the Service

FundMyCourse.ca provides:

  • A searchable database of Canadian scholarships, bursaries, grants, government programs, tax credits, employer tuition benefits, and other education funding opportunities.
  • Profile-based matching that compares your information against scholarship eligibility criteria.
  • An application tracking tool (Kanban board) to manage your scholarship applications.
  • A deadline calendar with optional reminders.
  • Educational content about education funding in Canada (guides, articles, calculators).

The Service is currently offered free of charge. If we introduce paid features in the future, we will update these Terms and provide advance notice before any such features are enabled on your account.

5. Scholarship Data Accuracy

5.1 Verification Efforts

We make reasonable efforts to verify the accuracy of scholarship and funding listings in our database. Our verification process includes confirming information with official sources, checking deadlines, and validating eligibility criteria. Each listing displays a "Last Verified" date.

5.2 No Guarantee of Accuracy

Despite our verification efforts, we cannot and do not guarantee that all information in our database is accurate, complete, or current at all times. Scholarship providers may change eligibility criteria, deadlines, award amounts, or other details without notice to us. Information provided by third-party sources may contain errors.

5.3 Your Responsibility

You are solely responsible for:

  • Verifying scholarship information directly with the scholarship provider before applying.
  • Confirming deadlines with official sources.
  • Ensuring you meet all eligibility requirements before investing time in an application.
  • Submitting applications through the official channels designated by the scholarship provider.

5.4 No Application Processing

FundMyCourse.ca does not process, review, evaluate, or make decisions on scholarship applications. We are a discovery and matching platform. All applications are submitted directly to the scholarship provider through their own channels.

5.5 No Guarantee of Awards

Using FundMyCourse.ca does not guarantee that you will receive any scholarship, bursary, grant, or other funding. Award decisions are made solely by the respective scholarship providers.

6. Acceptable Use

6.1 You Agree To

  • Use the Service only for its intended purpose: discovering, tracking, and applying for education funding.
  • Provide truthful information in your profile.
  • Respect the intellectual property rights of FundMyCourse.ca and third parties.
  • Comply with all applicable laws, including Canadian federal and provincial laws.

6.2 You Agree NOT To

  • Scrape, crawl, or use automated tools to extract data from the Service without our written permission.
  • Attempt to gain unauthorized access to our systems, servers, databases, or other users' accounts.
  • Use the Service to distribute spam, malware, or other harmful content.
  • Reproduce, distribute, or publicly display content from the Service without attribution and permission.
  • Impersonate another person or misrepresent your identity or affiliation.
  • Interfere with or disrupt the Service, including by overloading servers or introducing harmful code.
  • Use the Service for any commercial purpose without our written consent (e.g., reselling our data to other platforms).
  • Create fake accounts, submit false information, or manipulate matching results.
  • Harass, threaten, or abuse other users or FundMyCourse.ca team members through any communication channel.

6.3 Consequences of Violation

Violation of these acceptable use terms may result in:

  • Warning or temporary suspension of your account.
  • Permanent termination of your account.
  • Legal action, where appropriate.

We reserve the right to investigate suspected violations and to cooperate with law enforcement authorities.

7. Intellectual Property

7.1 Our Content

The FundMyCourse.ca website, including its design, layout, code, text, graphics, logos, and original content (such as educational articles and guides), is the intellectual property of FundMyCourse.ca and is protected by Canadian copyright and trademark law. You may not reproduce, distribute, modify, or create derivative works from our content without our written permission, except as permitted by fair dealing under the Canadian Copyright Act.

7.2 Scholarship Listing Data

Scholarship listings in our database are compiled from publicly available information and direct submissions from scholarship providers. Individual scholarship descriptions, eligibility criteria, and award details remain the intellectual property of the respective scholarship providers. Our compilation, organization, curation, and presentation of this data constitutes a copyrightable compilation.

7.3 Your Content

Any content you submit to FundMyCourse.ca (such as reviews, comments, or community contributions, if and when such features are available) remains your intellectual property. By submitting content, you grant us a non-exclusive, royalty-free, worldwide license to use, display, and distribute that content within the Service. You may withdraw this license by deleting your content.

7.4 Trademarks

"FundMyCourse," "FundMyCourse.ca," and associated logos and branding are trademarks of FundMyCourse.ca (pending registration). You may not use our trademarks without our prior written consent.

8. Premium Subscriptions

8.1 Paid Features

FundMyCourse.ca offers optional premium subscriptions with additional features. Premium features, pricing, and subscription terms are described on our pricing page. Free features remain free and are not degraded to incentivize premium upgrades.

8.2 Billing and Cancellation

  • Subscriptions are billed at the frequency you select (monthly or annually).
  • You may cancel your subscription at any time through your account settings.
  • Upon cancellation, you retain access to premium features until the end of your current billing period.
  • We do not offer prorated refunds for partial billing periods, except as required by applicable consumer protection law.

8.3 Price Changes

We may change subscription prices with at least 30 days' notice sent to your registered email address. Price changes apply only to new billing periods after the notice period. Existing subscribers are not affected until their next renewal.

9. Limitation of Liability

9.1 Service Provided "As Is"

FundMyCourse.ca is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

9.2 Limitation

To the fullest extent permitted by applicable law, FundMyCourse.ca, its operators, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

  • Loss of profits, revenue, or anticipated savings.
  • Loss of data.
  • Loss of scholarship opportunities due to inaccurate information on the Service.
  • Missed deadlines.
  • Any damages arising from your reliance on information provided by the Service.

9.3 Maximum Liability

In no event shall our total liability to you for all claims arising from or related to the Service exceed the greater of (a) the amount you paid to us in the 12 months preceding the claim, or (b) $100 CAD.

9.4 Jurisdictional Limitations

Some jurisdictions, including certain Canadian provinces, do not allow the exclusion or limitation of certain warranties or liability. In such jurisdictions, our liability is limited to the maximum extent permitted by law. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for fraud or gross negligence.

10. Indemnification

You agree to indemnify, defend, and hold harmless FundMyCourse.ca, its operators, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable legal fees) arising from:

  • Your use of the Service.
  • Your violation of these Terms.
  • Your violation of any third-party rights.
  • Any content you submit to the Service.

11. Third-Party Links and Services

The Service may contain links to third-party websites, including scholarship provider websites, government program pages, and educational institution sites. These links are provided for your convenience only. We do not endorse, control, or assume responsibility for the content, privacy practices, or terms of service of any third-party website. Your interactions with third-party websites are governed by their own terms and policies.

12. Modifications to the Service

We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice. We will make reasonable efforts to provide advance notice of material changes. We are not liable to you or any third party for any modification, suspension, or discontinuation of the Service.

13. Modifications to These Terms

We may revise these Terms from time to time. When we make material changes:

  1. We will update the "Last Updated" date at the top of this document.
  2. We will notify you by email at least 30 days before the changes take effect.
  3. We will display a prominent notice on the website.
  4. Continued use of the Service after the effective date constitutes acceptance of the revised Terms.
  5. If you do not agree with the revised Terms, you must stop using the Service and may delete your account.

14. Termination

14.1 Termination by You

You may terminate your account at any time by using the account deletion feature in your account settings or by emailing support@fundmycourse.ca. Upon termination, your personal information will be deleted in accordance with our Privacy Policy.

14.2 Termination by Us

We may suspend or terminate your account at any time if:

  • You violate these Terms or our Acceptable Use policy.
  • We are required to do so by law.
  • We reasonably believe your account has been compromised.
  • You have not logged in for 24 consecutive months (after providing 30 days' notice).

We will provide notice of termination by email to your registered address, except where we are legally prohibited from doing so or where immediate termination is necessary to prevent harm.

14.3 Effect of Termination

Upon termination:

  • Your right to access the Service ceases immediately.
  • Your personal information is deleted in accordance with our Privacy Policy.
  • Sections of these Terms that by their nature should survive termination (including Limitation of Liability, Indemnification, Governing Law, and Intellectual Property) will continue to apply.

15. Governing Law and Dispute Resolution

15.1 Governing Law

These Terms are governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles.

15.2 Jurisdiction

Any dispute arising out of or in connection with these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of the Province of Ontario, sitting in Toronto.

15.3 Informal Resolution First

Before initiating any formal legal proceeding, you agree to first contact us at legal@fundmycourse.ca to attempt to resolve the dispute informally. We will make good-faith efforts to resolve your concern within 30 calendar days.

16. General Provisions

16.1 Entire Agreement

These Terms, together with our Privacy Policy and Cookie Consent Policy, constitute the entire agreement between you and FundMyCourse.ca regarding the Service.

16.2 Severability

If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions will continue in full force and effect.

16.3 Waiver

Our failure to enforce any provision of these Terms does not constitute a waiver of that provision or our right to enforce it in the future.

16.4 Assignment

We may assign our rights and obligations under these Terms to a successor entity in the event of a merger, acquisition, or sale of assets, provided that the successor agrees to be bound by these Terms. You may not assign your rights or obligations under these Terms without our written consent.

16.5 Language

These Terms are drafted in English and will also be available in French. In the event of a conflict between the English and French versions, the English version prevails, except where prohibited by applicable law (including Quebec's Charter of the French Language for Quebec residents).
